Terms and Conditions
These Terms and Conditions ("Agreement") govern your use of Imity Health Services Pty Ltd's (ABN 51 668 256 577) ("we," "us," or "our") services. By accessing or using our services, you agree to be bound by the terms and conditions set forth in this Agreement. Please read this Agreement carefully before using our services. If you do not accept these Terms and Conditions, you should immediately cease accessing this site.
1. Services:
a. We provide services and related support to individuals seeking therapy for their healthcare needs.
b. Our services are delivered in accordance with applicable laws, guidelines, policies, and regulations, including those set forth by the National Disability Insurance Agency (NDIA), the NDIS Quality and Safeguards Commission, Australian Health Practitioner Regulation Agency (AHPRA) guidelines, the South Australian Health Care Act 2008, and the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
2. Client and NDIS Participant Responsibilities:
a. You agree to provide accurate and complete information about your health condition, medical history, and any other relevant details necessary for the provision of our services. b. You are responsible for attending scheduled appointments and providing a minimum of 48 hours' notice for any cancellation or rescheduling, as outlined in our Cancellation Policy.
c. You understand that our services are not a substitute for medical advice or treatment, and you should consult with appropriate healthcare professionals for any specific medical concerns.
d. As an NDIS participant, you acknowledge and understand your rights, responsibilities, and obligations as outlined by the NDIS legislation and policies.
e. You agree to provide accurate and complete information regarding your NDIS plan, goals, and any changes to your circumstances that may impact our service delivery.
f. You understand that the provision of our services is subject to your approved NDIS plan and budget.
3. Privacy and Confidentiality:
a. We are committed to protecting your privacy and maintaining the confidentiality of your personal information. Please refer to our Privacy Policy for details on how we collect, use, disclose, and protect your personal information in compliance with applicable privacy laws and regulations.
b. By using our services, you acknowledge and agree to the terms of our Privacy Policy.
4. Compliance with NDIS Policies and Regulations:
a. We comply with the NDIS Code of Conduct and the NDIS Practice Standards, including the Quality and Safeguards Framework, to ensure the provision of safe, quality services to NDIS participants.
b. We commit to maintaining appropriate qualifications, skills, and ongoing professional development as required by the NDIS regulations.
5. Intellectual Property:
a. All intellectual property rights related to our services, including but not limited to trademarks, logos, service marks, and content, are owned by or licensed to us.
b. You agree not to reproduce, modify, distribute, or use our intellectual property without our prior written consent.
6. Financial Responsibility:
a. As an NDIS participant, you understand and acknowledge your financial responsibility for the services received from Imity Health Services Pty Ltd.
b. You agree to provide accurate and up-to-date NDIS plan details and ensure that there are sufficient funds available in your plan budget to cover the cost of our services.
c. You are responsible for any outstanding payments, gaps in funding, or fees not covered by the NDIS plan.
d. In the event of any changes to your NDIS plan or funding, you agree to notify us promptly to discuss any potential impact on service provision and financial arrangements. e. Failure to fulfill your financial obligations may result in the suspension or termination of services, as permitted by the NDIS guidelines and relevant laws and regulations.
7. Non-Registered Provider and NDIA-Managed Participants:
a. Imity Health Services Pty Ltd is not a registered provider with the National Disability Insurance Agency (NDIA) and, therefore, unable to accept NDIA-managed participants.
b. It is the responsibility of the participant, their nominee, or referrer to ensure that they are not under NDIA-managed funding before engaging our services.
c. If a participant is under NDIA-managed funding, it is understood that the costs associated with our services will fall on the participant, and they will be responsible for payment arrangements directly with Imity Health Services Pty Ltd. Please note that as Imity Health Services Pty Ltd is not a registered provider, this provision is in accordance with the applicable regulations and requirements set forth by the NDIA. It is advisable for participants to consult with the NDIA or their relevant support coordinator to determine their funding management type before engaging our services.
8. Limitation of Liability:
a. To the extent permitted by law, we shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use of our services.
b. We make no guarantees or warranties regarding the outcomes or results of our services, as they may vary based on individual circumstances.
9. Governing Law and Jurisdiction:
This Agreement shall be governed by and construed in accordance with the laws of Australia and the state of South Australia. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of South Australia.
10. Modifications to the Agreement:
We reserve the right to modify or update this Agreement at any time without prior notice. Any changes will be effective immediately upon posting the revised Agreement on our website. Your continued use of our services after the modifications constitute your acceptance of the updated terms and conditions.
11. Severability:
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
12. Entire Agreement:
This Agreement constitutes the entire agreement between you and Imity Health Services Pty Ltd, superseding any prior agreements, communications, or representations, whether oral or written, relating to the subject matter herein.
